Terms of Sale

Article 1 — Scope and trader identification

These Terms of Sale ("Terms") govern all orders placed by consumers on my-pacha.com with:

Goods are dispatched from our UK fulfilment warehouse: 74 Kensington Road, Manchester M14 5PG, United Kingdom. This is a fulfilment-only address; please do not send returns there.

Article 2 — Formation of contract

(1) Display of products on the website does not constitute a binding offer but an invitation to place an order.

(2) The contract is formed when the Buyer confirms their order by clicking "Place order with payment obligation".

(3) An order acknowledgement is sent without delay by email. The contract becomes binding upon dispatch of the goods.

(4) Contract language: English.

Article 3 — Prices and unit pricing

(1) All prices are in pounds sterling (£) inclusive of VAT.

(2) In compliance with the Price Marking Order 2004, the price per kilogram is displayed alongside the total price for products sold by weight.

(3) Delivery charges are clearly displayed before order confirmation.

Article 4 — Payment

Payment is made via the methods offered at checkout (debit/credit card, PayPal, Apple Pay, etc.). The price is due upon contract formation.

Article 5 — Delivery

(1) Delivery is made to the address indicated by the Buyer in the United Kingdom.

(2) Unless otherwise agreed, delivery occurs within 5 working days of contract formation.

Article 6 — Retention of title

Goods remain the property of the Seller until full payment of the price.

Article 7 — Right to cancel (Consumer Contracts Regulations 2013)

(1) As a consumer purchasing at a distance, you have a statutory right to cancel within 14 days of receiving the goods, without giving any reason, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

(2) Full instructions on how to exercise this right and the model cancellation form are set out in our Refund Policy.

Article 8 — Statutory rights (Consumer Rights Act 2015)

(1) Goods supplied are subject to your statutory rights under the Consumer Rights Act 2015, including that they must be of satisfactory quality, fit for purpose, and as described.

(2) You have the right to a 30-day short-term right to reject faulty goods for a full refund, and further rights to repair, replacement, or refund within 6 months under the Act.

Article 9 — Voluntary commercial guarantee "Satisfied or your first bag free" (30 days)

(1) In addition to your statutory rights, the Seller offers a voluntary 30-day satisfaction guarantee from receipt of the goods.

(2) Content of the guarantee: If you are not satisfied with the product, the Seller will refund the purchase price. For a first order, you do not need to return the first bag — you keep it. For multi-bag orders, you keep the first bag; any additional unopened bags must be returned for a full refund.

(3) Geographic scope: United Kingdom.

(4) Guarantor: Emporia SASU (see Article 1).

(5) How to claim: Email support@my-pacha.com within 30 days of receipt.

(6) IMPORTANT NOTICE: This voluntary guarantee is in addition to and does not affect your statutory rights as a consumer under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013.

Article 10 — Liability

(1) Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any liability that cannot be excluded or limited under English law.

(2) Subject to (1), our liability for any loss arising from a breach of these Terms is limited to the price paid for the goods.

Article 11 — Complaints and dispute resolution

(1) If you have a complaint, please contact us first at support@my-pacha.com. We aim to resolve complaints amicably.

(2) Alternative Dispute Resolution (ADR): We are not currently a member of any ADR scheme. If we are unable to resolve your complaint, you may seek free and impartial advice from Citizens Advice (www.citizensadvice.org.uk — phone 0800 144 8848 in England, 0800 702 2020 in Wales).

(3) You may also bring proceedings in the courts of England and Wales.

Article 12 — Governing law and jurisdiction

(1) These Terms are governed by the laws of England and Wales. Mandatory consumer protection rules in your country of residence remain unaffected.

(2) The competent courts are those determined by statute in favour of the consumer.

Article 13 — Final provisions

(1) If any provision of these Terms is found to be invalid or unenforceable, the validity of the remaining provisions is not affected.

(2) The Seller reserves the right to amend these Terms with reasonable notice. The version applicable is the one in force at the time of contract formation.
